These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and Full Stack Tactical LLC (“Full Stack Tactical,” “we,” “us,” or “our”) governing your access to and use of the fullstacktacticalmarketing.com website and any related services.

Full Stack Tactical provides AI-powered marketing strategy, automation, content creation, and execution services for local businesses. Our services include but are not limited to growth campaigns, managed marketing retainers, and full-service marketing engagements.
Service Agreements: Specific scope, deliverables, timelines, and pricing for contracted services will be documented in a separate service agreement or statement of work (“SOW”). In the event of a conflict between these Terms and a specific SOW, the SOW shall govern with respect to the services described therein.
Results Disclaimer: While we employ industry best practices and data-driven strategies, we do not guarantee specific marketing outcomes, revenue increases, lead volumes, or other performance metrics unless explicitly stated in a written SOW. Marketing results depend on numerous factors beyond our control including market conditions, competition, product quality, and client responsiveness.

Our Content: All content on our website — including text, graphics, logos, design elements, frameworks, and methodologies — is the intellectual property of Full Stack Tactical LLC and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.
Client Work Product: Ownership of deliverables created during a service engagement will be specified in the applicable SOW. Generally, upon full payment, clients receive ownership of custom deliverables created specifically for their engagement. Full Stack Tactical retains ownership of pre-existing tools, templates, frameworks, AI agent configurations, and methodologies used in the delivery of services.
Portfolio Rights: Unless otherwise specified in a SOW, Full Stack Tactical reserves the right to reference client engagements in our portfolio and marketing materials in a general manner, without disclosing confidential information.
Payment terms for services will be specified in the applicable SOW or service agreement. General terms include:
Monthly Retainers: Either party may terminate a monthly retainer engagement with 30 days’ written notice. Client is responsible for payment through the end of the current billing period.
Project-Based Work: If a client terminates a project-based engagement before completion, the client is responsible for payment for all work completed to date, including any committed third-party costs.
For Cause: Either party may terminate immediately for material breach of these Terms or a SOW if the breach remains uncured for 15 days after written notice.
Effect of Termination: Upon termination, we will provide reasonable transition assistance including transfer of login credentials, access to client-owned assets, and export of client data from our platforms within 30 days of the termination date.
Both parties agree to keep confidential any proprietary or sensitive business information shared during the course of an engagement. This includes but is not limited to business strategies, financial data, customer lists, marketing plans, and technical configurations. Confidentiality obligations survive the termination of any service agreement for a period of two (2) years.
Our services may involve the use of third-party platforms including but not limited to GoHighLevel, Google Workspace, social media platforms, analytics tools, and advertising networks. Your use of these platforms is subject to their respective terms of service and privacy policies. Full Stack Tactical is not responsible for the availability, performance, or policies of third-party platforms.
Platform subscription costs (e.g., GoHighLevel, email services, advertising spend) are the responsibility of the client unless otherwise specified in a SOW.
To the maximum extent permitted by law, Full Stack Tactical LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from or related to your use of our website or services.
Our total aggregate liability for any claims arising from or related to these Terms or our services shall not exceed the total amount paid by you to Full Stack Tactical in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Full Stack Tactical LLC, its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising from your breach of these Terms, your use of our services, or any content or materials you provide to us for use in marketing activities.
Our website and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our website will be uninterrupted, error-free, or free of harmful components.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or our services shall be resolved through good faith negotiation between the parties. If negotiation fails, disputes shall be submitted to binding arbitration in Austin, Texas, in accordance with the rules of the American Arbitration Association.
We reserve the right to update these Terms at any time. Material changes will be communicated by posting the revised Terms on our website with an updated “Last updated” date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with any applicable SOW or service agreement, constitute the entire agreement between you and Full Stack Tactical regarding the subject matter herein and supersede all prior agreements and understandings, whether written or oral.
